1. Who we are

These terms govern your use of the website, tenant portal, and insurance services offered by Proximity Protect LLC ("Proximity Protect," "we," "us"), a Colorado-licensed insurance producer (CO License #676532, NPN 19782726). By using the site or binding a policy, you agree to these terms.

2. The service

Proximity Protect places workspace liability insurance for tenants of coworking, flex-office, and dedicated-desk workspaces in all 50 U.S. states. Coverage is placed on a surplus lines basis through One80 Intermediaries, Inc. (d/b/a Access One80) with Old Republic Union Insurance Company (NAIC #31143), a non-admitted insurer. 3. Eligibility & accuracy of information

You represent that you are at least 18, have authority to bind the named insured, and that all information you provide is true and complete. Misrepresentation may result in denial of a claim or rescission of the policy. See the fraud warning for state-specific notices.

4. Premium, taxes, fees

The price shown at checkout is your total recurring premium, inclusive of any applicable surplus lines taxes and stamping fees. We do not charge separate broker fees beyond what is displayed. Premium is billed on the cadence you select (typically monthly) via Stripe.

5. Coverage terms

The carrier's policy form, endorsements, declarations, and certificate of insurance are the controlling coverage documents. Marketing copy on this website is a summary, not a contract. In the event of any conflict between this site and the policy, the policy controls.

6. Cancellation & non-renewal

You may cancel at any time from your tenant dashboard or by emailing info@proximityprotect.com. Cancellations take effect at the end of your current billing period unless required otherwise by law or by the carrier. We may decline to renew coverage in accordance with applicable state insurance law.

7. Electronic delivery & signatures

You consent to receive policy documents, certificates, disclosures, billing notices, and required regulatory notices electronically. Where you click to accept, e-sign, or submit a form, that action constitutes your legally binding signature under the federal E-SIGN Act and applicable state law.

8. Acceptable use of the platform

Don't attempt to interfere with site security, scrape data, circumvent rate limits, impersonate other users, or use the platform for unlawful purposes. We may suspend access for abuse.

9. Disclaimers & limitation of liability

The website is provided "as is." We are not the insurer and do not pay claims; the carrier is the risk bearer. To the maximum extent permitted by law, our liability for any claim arising from your use of the website (separate from coverage under the policy itself) is limited to the fees you paid us in the twelve months preceding the claim.

10. Privacy

Your use of the site is also governed by our Privacy Policy and Cookie Policy.

11. Governing law & disputes

These terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws principles. Disputes arising under these terms are subject to the exclusive jurisdiction of the state and federal courts located in Colorado, except where your state's insurance code mandates a different forum for insurance-related disputes.

12. Changes

We may update these terms by posting a revised version with a new "Last updated" date. Material changes will be communicated by email or in-app notice where required.
